How Regulation Z's Right of Rescission Works in Refinancing

Under Regulation Z, when you refinance a mortgage on your primary home, federal law gives you a three-business-day window to cancel, counted from the latest of closing, delivery of the notice of your right to rescind, or delivery of all required disclosures.

If you are refinancing the mortgage on your primary home, federal law gives you a three-business-day window to cancel the new loan, counted from the latest of closing, delivery of the notice of your right to rescind, or delivery of all required disclosures. This explainer walks through how that window is counted under Regulation Z, using a Thursday closing as the example.

What the right of rescission actually is

Under 12 CFR 1026.23, when you refinance a loan secured by your principal dwelling, you have the right to cancel the new loan for a short period after closing. The clock runs for three business days, and it starts from the latest of three events: the day you sign the closing documents, the day you receive the official notice of your right to rescind, or the day you receive all of the required Truth in Lending disclosures. Because the countdown starts from whichever of those three things happens last, two people closing the same loan on the same day could end up with different deadlines if one of them receives paperwork late. This protection exists specifically for refinances and other transactions that are not used to buy the home — it is not a general cooling-off rule for all mortgages.

Why purchase loans don't get this protection

It's worth being clear about what this right does not cover, because the distinction trips people up. If you are buying a home with a mortgage, the loan is treated as a residential mortgage transaction, and that category is specifically exempted from the right of rescission. That means once you sign the closing documents on a home purchase, there is no three-day window to cancel the loan. The rescission right instead applies to refinances and other transactions secured by your principal dwelling that are not used to purchase the home.

Worked example: a Thursday closing

Say you sign your refinance paperwork on a Thursday, and that same day you receive both the notice of your right to rescind and all the required disclosures โ€” so all three triggering events happen at once. Your right to cancel stays open until midnight of the third business day after that trigger date, whichever of closing, notice delivery, or disclosure delivery occurred last. If your lender did not hand you the notice of right to rescind or all of the required disclosures on closing day itself, the count restarts from whenever you actually received the last of them, which could push your deadline out further.

 • closing day: 4
 • delivery day offset: 0
 • 3: 3
 • Formula: closing day + delivery day offset + 3
 • Result: 7

What happens after you cancel

If you decide to rescind, the clock then shifts to the lender's side. Once the creditor receives your written notice of rescission, it has 20 calendar days to return any money or property you paid in connection with the transaction and to take whatever steps are needed to show that its security interest in your home has been terminated. That 20-day period begins when the lender actually receives your notice, not when you mail it, so it is worth sending cancellation notices in a way that lets you confirm delivery.

When the window stays open much longer

The three-business-day period assumes the lender did its job correctly. If a lender never delivers the required notice of right to rescind, or never gives you all the material Truth in Lending disclosures, the normal three-day clock never actually starts. In that situation, your right to rescind extends dramatically โ€” up to three years after the closing date, or until you sell the property, or transfer all of your interest in the property, whichever comes first.

 • Notice of right to rescind — the document that starts the clock; if it's missing or incomplete, the standard three-day countdown does not begin.
 • Truth in Lending disclosures — these must also be delivered in full before the three-day period can start running, since the clock begins from the latest of closing, notice, or disclosure delivery.
 • Written notice of rescission — what you send the lender to cancel; the lender's 20-day refund and lien-release clock starts only once this is received.
Loan type Right of rescission applies? Cancellation window
Refinance of your principal dwelling Yes Three business days from the latest of closing, notice delivery, or disclosure delivery
Home purchase mortgage No None — exempt as a residential mortgage transaction once documents are signed
Refinance with missing notice or disclosures Yes, extended Up to 3 years after closing, or until the home is sold or transferred, whichever is first

If you want to cancel your refinance

 1. Check the date you signed closing documents, and the dates you received the notice of right to rescind and all required Truth in Lending disclosures โ€” your three-business-day window starts from whichever of those was last.
 2. Count forward three business days from that trigger date to find your deadline at midnight.

Key takeaways

 • Refinance closings on your primary home come with a three-business-day right to cancel, counted from the latest of closing, notice delivery, or disclosure delivery.
 • Home purchase mortgages don't get this right at all โ€” once you sign the closing documents, you have no right to cancel the purchase loan.
 • On a Thursday closing with same-day notice and disclosures, the three-business-day countdown starts the next day.
 • If you rescind, the lender has 20 calendar days after receiving your notice to refund money and release its lien.
 • Missing paperwork from the lender can stretch your cancellation right out to as long as three years after closing, but it ends sooner if you transfer all your interest in the property or sell it first, whichever happens first.

Frequently asked questions

Does the right of rescission apply to every mortgage?

No. It applies to refinances and other transactions secured by your principal dwelling that are not used to purchase the home; home purchase mortgages are exempted as residential mortgage transactions, so there is no cancellation window once you sign.

How exactly are the three business days counted?

The count starts the day after the latest of three events โ€” closing, delivery of the notice of right to rescind, or delivery of all required disclosures โ€” and runs for three business days.

What happens if I do rescind the loan?

The creditor has 20 calendar days after receiving your written notice of rescission to return any money or property collected in the transaction and to take steps showing its security interest is terminated.

What if my lender never gave me the rescission notice?

If the lender never delivered the required notice or all the material disclosures, the normal three-day clock never starts, and your right to rescind instead lasts up to three years after closing, upon transfer of all of your interest in the property, or upon sale of the property, whichever happens first.
